TERMS OF SERVICE Version 2026-09-13.3 1. USING GUERIN Guerin LLC operates Guerin. Business and copyright mailing details are available on the copyright contact page. These terms govern your use of Guerin. Questions and support requests can be sent to contact@guerinapp.com. Review these terms and the Privacy Policy before continuing. If you do not agree, do not use the service. You must be at least 13 years old. If you are under 18, you must have your parent or guardian’s permission. Give accurate account information and keep your login credentials secure. Your birthday is private account information. Confirming it is a declaration, not identity verification. 2. YOUR CONTENT AND PERMISSIONS You retain your rights in content you upload. You must have the rights or other lawful basis needed for the uses you request, including hosting, playback, processing and sharing. One person’s permission may not cover all rights in a recording, composition, video, image, artwork or text. You authorize Guerin and its service providers to store, transmit, display and process your submitted content as needed to provide the features you request and enforce applicable account, privacy and content restrictions. This includes cloud processing of uploaded media to generate audio stems and related playback information. Your visibility settings control ordinary sharing; authorized reviewers may access restricted material when necessary to address reports, copyright cases or security issues. A rights declaration, recognition result or successful upload does not establish ownership or provide a license to someone else’s work. Playback effects, credit and a short duration alone do not establish permission. Permissions for playback, stems and any separately offered export or remix use may differ. 3. COMMUNITY AND SAFETY Do not upload, distribute or use Guerin for unlawful content or activity, child sexual exploitation, threats, harassment, hate or abuse, privacy violations, impersonation, harmful code, spam, or attempts to evade access restrictions. Do not submit knowingly false reports or rights claims. Use the in-app reporting and blocking controls or contact contact@guerinapp.com for support. We may restrict content or accounts after review and keep records of decisions and related appeals. A report does not by itself establish a violation. 4. A telephone call or ordinary platform appeal does not replace a written DMCA notice or counter-notice. Notices of claimed infringement If you own the affected copyright or are authorized to act for its owner, provide substantially the following information: 1. Your physical or electronic signature as the owner or authorized representative. 2. The copyrighted work you claim was infringed, or a representative list for multiple works at a single online site. 3. The material you ask us to remove or disable, with enough information to locate it, such as its Guerin post link. 4. Contact information sufficient to reach you, including an address, telephone number and, if available, email address. 5. A statement of your good-faith belief that the complained-of use is not authorized by the copyright owner, its agent or the law. 6. A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed. Consider applicable permissions and legal exceptions before submitting a notice. We may request missing information. For a notice that substantially meets the DMCA requirements, our procedure is to act expeditiously to remove or disable access to the identified material and take reasonable steps promptly to notify the affected uploader. Counter-notices If your material was removed or disabled in response to a copyright notice and you believe this resulted from mistake or misidentification, you may send our designated agent a written counter-notice containing substantially: 1. Your physical or electronic signature. 2. Identification of the removed or disabled material and where it appeared before removal or restriction. 3. Your statement, under penalty of perjury, of a good-faith belief that the removal or restriction resulted from mistake or misidentification. 4. Your name, address and telephone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district containing your address. If your address is outside the United States, consent to jurisdiction in any judicial district where Guerin LLC may be found. State that you will accept service of process from the person who sent the infringement notice or that person's agent. We promptly provide the original notice sender with a copy of a qualifying counter-notice, including the contact information it contains, and inform them of the planned restoration after 10 business days. The DMCA restoration window is no earlier than 10 and no later than 14 business days after receipt of the qualifying counter-notice, unless our agent first receives notice that the original sender has filed an action seeking a court order to restrain infringement relating to that material. This process addresses the disputed copyright removal; independent lawful restrictions may still apply. Knowingly making a material misrepresentation in a notice or counter-notice can result in liability under the DMCA, including damages, costs and attorneys' fees. Platform review and repeat infringement Ordinary platform appeals are separate from statutory counter-notices. You can provide context and permission evidence through available account copyright case tools or contact@guerinapp.com. We may review permissions, restrict access or processing, and consider an affected uploader's explanation. A reversal applies only to the reviewed claims and does not clear unrelated restrictions. Guerin's policy provides for termination of account holders who are repeat infringers in appropriate circumstances, following review of the relevant incidents and responses. An allegation or automated match alone does not establish infringement. Attempts to evade an account restriction may also result in account action. The platform's 90-day active strike window is an account-review mechanism. Three active strikes require administrator review; the counter does not automatically terminate an account. We retain incident and reversal history. Strike expiry does not erase that history, establish that an account is in good standing for every purpose, or automatically restore restricted content. Review of repeat infringement may consider relevant history beyond the active strike counter. 5. SUBSCRIPTIONS AND PAYMENTS Subscriptions purchased in the iOS app are billed through Apple’s App Store. The purchase screen shows the product, price, duration and any trial terms before you confirm. Access depends on a verified purchase or entitlement. Auto-renewable subscriptions renew unless canceled under the terms shown by Apple. Manage or cancel them in your Apple account subscription settings. Deleting Guerin or a Guerin account does not by itself cancel an Apple subscription. Refund requests for App Store purchases are handled through Apple, subject to Apple’s policies and applicable law. Nothing in these terms removes rights you have under applicable consumer law. 6. SERVICE CHANGES AND ACCOUNT ACCESS Features may change or be interrupted. We may restrict access where needed to address a policy violation, legal requirement or security problem. You may stop using Guerin and request account deletion through the available account settings. Certain case, security or transaction records may need to be retained as described in the Privacy Policy. 7. PRIVACY AND THIRD-PARTY SERVICES The Privacy Policy explains account information, uploaded content, messages, processing providers, copyright evidence and sharing. Third-party services may have their own terms. Previously delivered or independently copied content cannot always be recalled after deletion or a restriction. 8. CONTACT AND UPDATES Contact contact@guerinapp.com about these terms, account corrections, reports or appeals. Material policy updates will be identified by a new version. Where a new acknowledgement is required, Guerin will present the applicable versions before account access continues.
